These Terms of Use govern your access to and use of the Expired.Food – NFC Tracker mobile application and related services (collectively, the “App”). By downloading, accessing, or using the App, you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

1. About the App

Expired.Food – NFC Tracker is a food tracking application designed to help users manage food items in places such as a fridge, freezer, or pantry. The App may allow users to associate food items with NFC tags, track expiration dates, receive reminders, and access optional AI-powered assistance features.

2. Eligibility

You must comply with all applicable laws when using the App. By using the App, you represent that you are legally permitted to do so in your jurisdiction.

3. Free and Paid Access

The App may offer both free and paid access levels.

• Free Tier: The free version of the App currently allows tracking of up to 5 items.
• Premium Access: Premium access may unlock features such as unlimited food tracking, unlimited NFC linking, and other premium functionality made available within the App.

4. Subscriptions and Lifetime Purchase

The App may offer the following paid options through Apple’s In-App Purchase system:

• Monthly subscription
• Yearly subscription
• Lifetime non-consumable purchase

Pricing is displayed in the App Store at the time of purchase and may vary by region.

Auto-renewable subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

You may manage or cancel subscriptions in your Apple account settings after purchase. If you purchase a lifetime unlock, that purchase is a one-time non-consumable purchase that provides ongoing access to the associated premium features for as long as the App and those features remain available.

5. AI Credits and AI Features

The App may include optional AI-powered features designed to assist users with food organization, analysis, or related functionality.

Use of certain AI features requires the use of in-app credits (“AI Credits”). One AI Credit is consumed each time an AI-powered action or request is performed.

AI Credits may be provided through:

• Premium subscriptions (which may include a recurring allocation of AI Credits)
• Annual subscription allocations
• Lifetime purchases (which may include a one-time allocation of AI Credits)
• Consumable in-app purchases of additional AI Credit packs

AI Credits granted through subscriptions may expire at the end of the applicable billing cycle. AI Credits granted through lifetime purchases or consumable purchases may remain available until used unless otherwise specified in the App.

AI Credits are a virtual in-app resource, have no monetary value, are non-transferable, and cannot be redeemed for cash or other goods or services outside the App.

We reserve the right to modify the number of AI Credits required for certain features, adjust credit allocations, or modify AI functionality as the App evolves.

6. Billing and Refunds

All purchases are processed by Apple, not by us directly. Billing, cancellations, and refunds are governed by Apple’s terms and policies. If you want to request a refund, you must do so through Apple.

7. No Guarantee of Food Safety

The App is provided as an organizational and reminder tool only. Expiration dates, reminders, and other information presented by the App may depend on user input and other factors. The App does not guarantee food freshness, food safety, or suitability for consumption.

You are solely responsible for evaluating whether food is safe to consume. Always use your own judgment and follow proper food safety guidance.

8. User Responsibilities

You agree that you will:

• Provide accurate information when entering food items and dates;
• Use the App only for lawful purposes;
• Not attempt to interfere with, disrupt, or misuse the App;
• Not copy, reverse engineer, resell, or exploit the App except as permitted by law.

9. NFC Functionality

Certain features may rely on NFC-capable devices, compatible NFC tags, and supported iOS functionality. We do not guarantee that NFC features will work on every device, operating system version, tag type, or usage scenario.

10. Availability and Changes

We may update, modify, suspend, or discontinue any part of the App, including features, pricing, or availability, at any time. We may also impose limits on certain features or restrict access to parts of the App.

11. Intellectual Property

The App, including its design, branding, software, text, graphics, and related content, is owned by us or licensed to us and is protected by applicable intellectual property laws. These Terms of Use do not transfer any ownership rights to you.

12. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, secure, or suitable for your specific needs.

13. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, food, profits, revenue, or business arising from or related to your use of the App.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the App will not exceed the amount you paid, if any, for the App or related in-app purchases during the 12 months before the claim arose.

14. Termination

We may suspend or terminate your access to the App if you violate these Terms of Use or if we reasonably believe it is necessary to protect the App, users, or our rights.

15. Apple Terms

If you access the App through an Apple device, you acknowledge that these Terms of Use are between you and us, not Apple. Apple is not responsible for the App or its content, except as required under applicable law and Apple’s standard terms.

16. Governing Law

These Terms of Use will be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles, except where otherwise required by law.

17. Changes to These Terms

We may update these Terms of Use from time to time. Continued use of the App after any update becomes effective constitutes your acceptance of the revised Terms.

19. Standard Apple EULA Notice

Where applicable, your use of the App is also subject to Apple’s Licensed Application End User License Agreement (EULA).
